    ORDER OF THE BOARD (by J.P. Novak):
     
    On August 19, 2004, at the parties’ request, the Board extended until November 3, 2004,
    the time period for Premcor Refining Group (Premcor Refining Group, Inc.) to appeal a June 30,
    2004 determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. The Agency modified
    petitioner’s high priority corrective action plan budget for Premcor Refining Group’s leaking
    underground petroleum storage tank facility located at 101 Lincoln Street, in Streator, La Salle
    County. Because petitioner failed to timely file an appeal, the Board dismisses this case and
    closes the docket.
