ORDER OF THE BOARD (by M.E. Tristano):

This matter comes before the Board on its own motion following Millenium Recycling
and Solid Waste Consultants’ (respondent) failure to attend a telephonic status conference on
    July 30, 2003.

On December 12, 2001, the People of the State of Illinois (complainant) filed a four-
count complaint against respondent. On April 23, 2003 and July 30, 2003, respondent failed to
appear at telephonic status conferences. On August 5, 2003, the hearing officer referred this
matter to the Board for the appropriate sanctions against respondent.

Section 103.220 of the Board’s procedural rules states:

Failure of a party to appear on the date set for hearing or failure to proceed as
ordered by the Board shall constitute a default. 35 Ill. Adm. Code 103.220.

The Board orders respondent to show cause why a default order in this case should not be
entered. Millenium Recycling and Solid Waste Consultants have 14 days, or until September 4,
2003, to respond to this order.

    IT IS SO ORDERED.

I, Dorothy, M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on August 21, 2003, by a vote of 7-0.
