HEARING OFFICER ORDER
On August 24, 2005, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it intends to file a motion for summary judgment.
The respondent then represented that it will file a motion for summary judgment as well.
A briefing schedule was discussed and agreed to. The respondent must file the record in
the above-captioned matter by August 31, 2005. The parties’ respective motions for summary
judgment are due to be filed on or before September 15, 2005. The parties’ respective responses
are due to be filed on or before September 29, 2005. The parties’ respective replies are due to be
filed on or before October 6, 2005.
The petitioner represented that it will file a waiver of the statutory decision deadline to
and including February 17, 2006.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on October 13, 2005, at 11:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
