ORDER OF THE BOARD (by M. McFawn):

On March 5, 2001, Plexus Scientific Corporation (Plexus) filed a petition for variance
from the prohibition against open burning found at 35 Ill. Adm. Code 237.102. Plexus’
petition requests the variance to allow the open burning/“flashing” of buildings and process
equipment located at the load/assemble/package area of the former Joliet Army Ammunition
Plant (JOAAP) site in Will County, Illinois. The “[o]pen burning of wastes creating a hazard
of explosion, fire or other serious harm” may only be permitted through the granting of a
variance. 35 Ill. Adm. Code 237.103. Plexus’ requested a hearing in its petition.

On April 5, 2001, the Board issued an order directing Plexus to file an amended petition
to address deficiencies in two areas. The Board stated that if Plexus’ amended petition and the
Illinois Environmental Protection Agency’s recommendation were timely filed pursuant to the
April 5, 2001 order, hearing could commence on May 2, 2001, in advance of the Board’s
formal acceptance of this matter for hearing.

On April 23, 2001, Plexus filed an amended petition
    1
    containing additional information
that addressed the areas of deficiency identified by the Board in its April 5, 2001 order. On
April 27, 2001, the Agency filed its recommendation in support of granting Plexus’ petition.

The Board hereby accepts this matter for hearing. Consistent with the April 5, 2001
order, the Board will endeavor to reach an expedited decision in this matter by late June or
    early July.

    IT IS SO ORDERED.

Board Member S.T. Lawton, Jr. abstained.
    1
Plexus captioned its April 23, 2001 amended petition as “supplemental information.”
