    ORDER OF THE BOARD (by E.Z. Kezelis):
    On November 22, 1999, the Illinois Environmental Protection Agency (Agency) filed a motion
    to dismiss these consolidated cases. In its motion, the Agency states that a negotiated settlement
    involving supplemental reimbursement to Raymond S. Hara (Hara), was reached on or before April 5,
    1999. Although the supplemental reimbursement was issued to Hara, these proceedings have never
    been dismissed. Accordingly, the Agency now seeks dismissal.
    In an order dated November 10, 1999, the Board’s hearing officer scheduled a telephonic
    status conference for November 18, 1999, and advised the parties that failure to participate could result
    in a referral of these matters to the Board for dismissal. According to a hearing officer order dated
    November 30, 1999, Hara failed to participate in the conference call.
    Based upon the information contained in the Agency’s motion and upon Hara’s lack of
    participation in these proceedings, the Agency’s motion is granted, this matter is dismissed with
    prejudice, and this docket is hereby closed.
    IT IS SO ORDERED.
