Proposed Rule. Dismissal Order.
ORDER OF THE BOARD (by E.Z. Kezelis):
Section 13(c) of the Environmental Protection Act (Act) (415 ILCS 5/13(c) (1996))
requires the Board to adopt regulations which are “identical in substance,” as defined at
Section 7.2 of the Act, to underground injection control (UIC) regulations that the United
States Environmental Protection Agency (USEPA) adopted to implement provisions of the Safe
Drinking Water Act, 42 U.S.C. § 300h
et seq
. (1996). USEPA has codified its UIC
regulations at 40 C.F.R. 144 through 148. The Board reserved this docket for any UIC
amendments adopted by USEPA between July 1, 1998, and December 31, 1998.
During that time period, USEPA amended its UIC regulations twice in the course of
amending its hazardous waste rules under Subtitle C of the federal Resource Conservation and
Recovery Act of 1976 (RCRA Subtitle C), 42 U.S.C. §§ 6921
et seq
. (1996). On August 6,
1998 (63 Fed Reg. 42109), USEPA adopted new waste listings and land disposal restrictions
for petroleum wastes, including certain exclusions from regulation as hazardous waste. On
August 10, 1998 (63 Fed Reg. 42580), USEPA changed the effective dates of the land
disposal restrictions for organobromine production wastes. The Board incorporated these UIC
and RCRA Subtitle C amendments into the consolidated RCRA Subtitle C and UIC update
dockets R98-21/R99-2/R99-7 adopted on December 17, 1998. No further action is required
on these UIC amendments. Therefore, the Board hereby dismisses this docket.
