    (UST - Appeal)
ORDER OF THE BOARD (by C.A. Manning):
On March 17, 1998, the Illinois Environmental Protection Agency (Agency) issued a
final decision, denying Jake Seabury’s (petitioner) request for reimbursement from the
Underground Storage Tank Fund. By a letter dated April 21, 1998, petitioner requested that
the Agency grant a 90-day extension of the 35-day appeal period. A copy of this letter was
received by the Board on April 23, 1998. The Agency subsequently denied the request for an
extension by letter dated April 30, 1998, and received by the Board on June 4, 1998. The
grounds for the denial of the extension was that the request, received by the Agency on
April 23, 1998, was not timely.
On June 17, 1998, the Board issued an order instructing the petitioner to file an
amended petition within ten days or this matter would be subject to dismissal. Because
petitioner has failed to file an amended petition within the requisite timeframe as ordered by
the Board on June 17, 1998, the Board dismisses this matter and closes the docket.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the 1st day of October 1998 by a vote of 7-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
