ORDER OF THE BOARD (by R.C. Flemal):
On May 14, 1998, the Illinois Environmental Protection Agency (Agency) and petitioner filed a
request for a 90-day extension of the 35-day appeal period for petitioner’s facility located at the
Belvidere Oasis on I-90 west bound. By order of May 21, 1998, the Board docketed the matter as
PCB 98-157 and granted the request for extension. On July 6, 1998, the Board received petitioner’s
petition for review in PCB 98-157. PCB 98-157 is accepted for hearing.
On June 17, 1998, the Board consolidated twelve similar underground storage tank refund
appeal cases brought by petitioner. On its own motion, the Board hereby consolidates petition PCB
98-157 with the twelve previously consolidated cases. Like those cases, PCB 98-157 has a decision
deadline of March 31, 1999. Also, the facts and issues of this case are substantially similar to the
previously consolidated cases. Today’s caption reflects the latest consolidation.
As with the other cases in this consolidated matter, the Board notes that Board rules require
the Agency to file the entire Agency record of the site classification work plan and budget
amendment. See 35 Ill. Adm. Code 105.102. Hearing must be scheduled and completed in a timely
manner, pursuant to the applicable statutory decision deadline, or the decision deadline as extended
by a waiver. See 35 Ill. Adm. Code 101.105.
    IT IS SO ORDERED.
    Board Member N.J.
    Melas abstained.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that the above
order was adopted on the 23rd day of July 1998 by a vote of 5-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
