    ORDER OF THE BOARD (by C.A. Manning):
    This matter is before the Board on a motion to voluntarily dismiss without prejudice
    filed by Quantum Chemical Corporation on May 17, 1996. The Board notes that the motion
    to voluntarily dismiss cannot be granted without prejudice because any subsequent filing of the
    procedures by petitioner would be untimely pursuant to Section 40 of the Environmental
    Protection Act (415 ILCS 5/40 (1994)). The motion to dismiss is hereby granted and the
    docket is closed.
