    ORDER OF THE BOARD (J. Theodore Meyer):
    This matter is before the Board on the parties' October 16,
    1995 Agreed Motion to Request Extension of Time to Set Hearing
    Date. The parties state that the complaint was filed on June 20,
    1995. Pursuant to 35 Ill. Adm. Code 103.125(a), respondent,
    Polymer Color, Inc. is required to file its answer by July 21,
    1995. The parties report that negotiations have begun and a
    draft settlement is currently before the Illinois Environmental
    Protection Agency. The parties ask for additional time to
    mediate the issues, the major issue being the amount of civil
    penalty and therefore request an extension of the required
    hearing time frame from 90 days to December 31, 1995.
    The Board grants the parties' request to extend the hearing
    time frame requirement from 90 days to December 31, 1995. The
    hearing officer assigned to this matter shall order a status date
    for December 15, 1995 in which the parties shall indicate an
    anticipated date of resolution in this matter.
