ORDER OF THE BOARD (by E. Dunham):

On October 23, 1995, American Waste Processing (American)

filed a status report in response to the Board order of August

24, 1995. Petitioner has provided the Board with an open waiver

of the decision deadline in this matter.

After the hearings in this matter were concluded, the

parties agreed that the petitioner should file a new Part B

application. A new Part B permit application has been filed by

petitioner and has been accepted for completeness by the Agency.

A draft permit was issued on May 24, 1995 with a forty-five day

comment period. No comments were received during the comment

period. A permit was issued on September 29, 1995 with an

effective date of November 3, 1995. Petitioner is reviewing the

content of the permit. American requests that the Board continue

to defer consideration of the record in this matter until the

review process is complete.

The Board will continue to defer review of this matter. The

Board directs the parties to file status reports or a joint

status report on or before December 15, 1995, unless this case is

otherwise resolved or dismissed.
