ORDER OF THE BOARD

This matter is before the Board on a stipulation of
settlement and dismissal,
filed jointly by petitioner Robert
Schwake Stone Company,
Inc.
(Schwake) and respondent Illinois
Environmental Protection Agency
(Agency)
on October 10,
1995.
The parties stipulate that the Agency will approve reimbursement
to Schwake from the Underground Storage Tank Fund for the
following costs:
1)
$11,378.31 for costs previously denied as
lacking supporting documentation;
2)
$2,728.46 for costs
previously denied as costs associated with a tank ineligible for
reimbursement; and 3)
$295.00 for cost previously denied as costs
not demonstrated to be reasonable.
The Agency has agreed to
reimburse these costs based on Schwake’s submittal of additional
documentation and clarification of costs.
All other costs for
which reimbursement was denied in the invoice voucher dated March
8,
1994 shall not be reimbursed.
Based upon this agreement,
Schwake withdraws and dismisses its petition in this matter.
This matter is dismissed and this docket is closed.
