    On November
    3,
    1994,
    the Board granted the petitioner a
    temporary exception for combined sewer overflow until September
    1,
    1995 unless the petitioner filed an amended petition for
    permanent relief.
    On September
    1,
    1995,
    the petitioner filed an
    amended petition and a motion for leave to file a limited number
    of copies of Exhibits A and B.
    On September
    7,
    1995, the Board
    granted the motion to file limited copies and indicated that
    it
    would hold decision on the merits until the Agency files
    a
    response to the amended petition.
    At this time the Board has not
    received a response from the Agency.
    Therefore, the Board
    directs the Agency to file a response to the amended CSO petition
    or any other appropriate motion by November 17,
    1995.
