    ORDER OF THE BOARD
    (by M. McFawn):
    This matter
    is before the Board on a joint status report
    filed by petitioner Minnesota Mining and Manufacturing Co.
    (3M)
    and the Illinois Environmental Protection Agency
    (Agency)
    on
    August
    1,
    1995.
    This status report was timely submitted in
    response to a February 9,
    1995 Board order.
    As in their previous status report,
    filed February
    1,
    1995,
    the parties state that 3M is seeking a variance from 35 Ill.
    Adm.
    Code 218.105(c), which requires that the capture of VOM emissions
    from paper coating lines be demonstrated after construction of a
    total closure around the source to contain fugitive emissions.
    This section of the Board rules
    is identical to and derived from
    Section 52.741(a) (4)
    of the Federal Implementation Plan for Ozone
    (FIP).
    3M filed a request to revise the FIP with the United
    States Environmental Protection Agency
    (USEPA)
    in May 1991.
    The
    parties assert that USEPA stated it would delay its decision on
    3M’s FIP revision request until
    it issued a revised capture
    efficiency guidance document.
    The Agency has indicated it will
    follow USEPA’s decision on capture efficiency protocols.
    The parties report that the USEPA issued its Revised Capture
    Efficiency Guidance on February
    7,
    1995.
    However, USEPA has not
    yet issued its decision on 3M’s FIP revision petition.
    3M is now
    investigating whether the use of statistical methods contained in
    the Revised Guidance will enable 3M to demonstrate compliance
    with the capture efficiency requirements.
    The parties therefore
    believe that this matter should be continued until USEPA issues
    its decision on 3M’s FIP revision petition.
    They request that
    the Board order another status report to be filed on or before
    February
    1,
    1996.
    The parties note that 3M has filed a waiver of
    the decision deadline until December 31,
    1996.

    The Board accepts the joint status report.
    As requested by
    the parties, the next status report in this matter must be filed
    on or before February 1,
    1996.
