    ORDER OF THE BOARD
    (by E. Dunham):
    On August 7,
    1995, American Waste Processing (American)
    filed a status report in response to the Board order of May 25,
    1995.
    Petitioner has provided the Board with an open waiver of
    the decision deadline in this matter.
    After the hearings in this matter were concluded,
    the
    parties agreed that the petitioner should file a new Part B
    application.
    A new Part B permit application has been filed by
    petitioner and has been accepted for completeness by the Agency.
    A draft permit was issued on May 24,
    1995 with a forty-five day
    comment period.
    No comments were received during the comment
    period.
    A permit is expected to be issued by September 1,
    1995.
    American requests that the Board continue to defer consideration
    of the record in this matter.
    The Board will continue to defer review of this matter.
    The
    Board directs the parties to file status reports or a joint
    status report on or before October
    6,
    1995, unless this case is
    otherwise resolved or dismissed.
