I am dissenting in this matter to simpiy point out that the

Illinois Environmental Protection Agency

(Agency)

filed a Motion

to Dismiss Petition for Review.

Since the Agency controls this

type of case,

the motion should be granted.

To do otherwise is

to practice law for the Agency,

which

is above and beyond the

call of duty for the Board.

For these reasons,

I respectfully dissent.
