ORDER OF THE BOARD
(by C.A. Manning):
This matter is before the Board on a motion for extension of
time that the Board received via fax on February
1,
1995.
By its
representative, P&P International Inc.,
Mr.
“C” Food
& Liquor
(Mr.
“C”) requests a 30-day extension,
or until March 15,
1995,
in which to file an amended petition.
On January 11,
1995 the
Board found Mr. “C”s petition to review an Office of State Fire
Marshal
(OSFM)
determination insufficient and directed Mr.
“C” to
file an amended petition on or before February 9,
1995.
Mr.
“C”
requests additional time in order to have an attorney prepare the
amended petition.
The motion is hereby granted and Mr.
“C” now has until March
15,
1995 to file an amended petition satisfying the petition
content requirements of 35 Ill.
Adm. Code 107.122 and to offer
proof that the petition for review was served on the OSFM.
In the future,
the Board will not accept “fax” filings and
all documents Mr.
“C” wishes to submit to the Board must be filed
either in person or by mail as stated in the Board’s procedural
rules.
In this instance we will accept the fax filing because
when we attempted to contact Mr. “C”s representative to request
that the motion for extension of time and the requisite number of
copies be mailed to the Board, the telephone number was
disconnected.
As we stated in our January
11 order,
a copy of
the Board’s recently—adopted procedural rules governing appeals
from OSFM decisions is available through the Clerk’s Office as
well as our general procedural rules governing practice before
the Illinois Pollution Control Board.
We strongly urge Mr. “C”s
representative to obtain a copy so as to not jeopardize Mr. “C”s
appeal before the Board.
