ORDER OF THE BOARD
(by R.C. Flemal):
On November 30,
1994 R. Lavin
& Sons,
Inc.
(Lavin) and the
Illinois Environmental Protection Agency
(Agency)
filed status
reports pursuant to Board order of September 15,
1994.
Lavin states that the Agency has made a settlement proposal,
premised on Lavin submitting additional stormwater data.
Both
parties acknowledge that Lavin has been submitting stormwater
data to the Agency on an ongoing basis.
The Agency states that
it requires additional data in order to have a representative
sample of Lavin’s stormwater.
Lavin expects this case will be
settled and not proceed to hearing.
The Board accepts the parties’
status reports and directs
all future status reports to be filed at the discretion of the
hearing officer.
