On February 7,
1992, the Stiffel Company (Stiffel)
filed a
petition for an adjusted standard from 35 Ill.
Adin. Code 218
Subpart
F.
Stiffel and the Illinois Environmental Protection
Agency
(Agency) have indicated that they have reached an
agreement on a plan for achieving compliance in this matter.
The
joint status report filed by the parties on September 9,
1994,
states that agreement has been achieved and that Stiffel has been
operating under that agreed compliance plan.
However, the Agency
has requested additional information which Stiffel provided on
September 29,
1994.
The parties,
however, still state that a
consent agreement has not been finalized and request an
additional three

month stay.
The previous joint status report filed on March
2,
1994,
explained that the Agency found Stiffel’s plan regarding
compliance with the 35
Iii. Adm. Code Part 218, Subpart F
regulations to be acceptable.
The Agency and Stiffel anticipated
that the consent agreement which will be referred to the Office
of the Attorney General for finalization was pending.
However,
in this status report the parties state that no referral has been
made but preparation is taking place.
The parties’ motion for stay is granted until March 16,
1995.
An updated joint status report is due to be filed on or
before March 10,
1995.
