ORDER OF THE BOARD

This matter is before the Board upon an amended petition for
exception from the Board’s combined sewer overflow (CSO)
regulations filed by the City of Morris
(Morris) on October 21,
1992.
Morris currently holds a temporary exception from the CSO
regulations’.
In the instant petition Morris seeks to make the
exception permanent.
Among recent developments was the filing on July 11,
1994 by
Morris of additional information.
By filing of October 31,
1994,
the Illinois Environmental Protection Agency
(Agency) now seeks
leave to file a response.
The Agency observes that information
in the July 11 filing, plus other information which has come to
the Agency’s attention as recently as October 20,
1994, has
caused the Agency to reexamine its earlier position in this
matter.
In particular,
the Agency supports grant of the
permanent CSO exception subject to conditions as set out in its
October 31,
1994 filing.
The Agency’s Motion for Leave to File Agency Reply as filed
on October 31,
1994
is hereby granted.
The Board hopes that these developments will now allow this
matter to be brought to final resolution.
Absent other
developments, the Board accordingly intends to bring this matter
to decision consistent with Board resources and time constraints.
IT IS SO ORDERED.
The temporary exception was granted based on a petition
filed in 1986.
The Board has retained jurisdiction during the
pendency of the temporary exception, which accounts for the
continued use of the original docket number.
