ORDER OF THE BOARD

(by E. Dunham):

On July 21,

1994, the Board granted a stay of review of the

record in this matter until October

1,

1994.

An open waiver of

the decision deadline has been provided by the petitioner.

The

last hearing in this matter was held on February 23,

1993,

and

the petitioner’s reply brief was filed on August

11,

1993.

As a

result of the hearings and briefs, the parties agreed that it was

in the best interest of all concerned for the Illinois

Environmental Protection Agency (Agency)

to further review this

matter.

Petitioner filed a new permit application with the

Agency.

The parties met on June

15,

1994,

to discuss some of the

technical issues relating to the permit.

As a result of this

meeting the Agency stated that a draft permit may be issued.

The Board directs the parties to file status reports on or

before November 18,

1994.

The status reports shall indicate the

present status of any negotiations and if the parties desire to

proceed to a review of the record in this matter.

If the parties

request that the Board proceed to a decision on the record,

the

Board requests that the parties address whether any additional

hearings or filings are necessary to update the record.
