    ORDER OF THE BOARD
    (by C.A. Manning):
    On January 19,
    1993,
    the US. Department of the Army
    (Department), filed an amended petition for review of the
    Illinois Environmental Protection Agency’s (Agency) denial of its
    Resource Conservation and Recovery Act (RCRA) Part B permit.
    The
    Department filed
    a waiver of the statutory decision deadline on
    January 26,
    1993.
    The Department’s most recent status report
    filed on July
    14,
    1994,
    stated that it was attempting to resolve
    the matter without proceeding to hearing and that upon Agency
    approval of a closure plan for the facility it would withdraw its
    permit appeal petition.
    Based on this status report, on July 21,
    1994,
    the Board directed the parties to file individually or
    jointly an updated status report on or before September 9,
    1994
    if the Department’s motion to withdraw this permit appeal was not
    received.
    As of the date of this order, neither the motion to withdraw
    the permit appeal nor an updated status report has been filed in
    this matter.
    The parties are directed to file a status report on
    or before October 28,
    1994.
    If no such status report is filed,
    this matter will be set for hearing or, alternatively, may be
    subject to dismissal for want of prosecution.
