ORDER OF THE BOARD

On September 14,
1994 the Illinois Environmental Protection
Agency
(Agency)
filed a motion seeking an extension of time until
December
1,
1994
in which to file its response to the petition of
Outboard Marine Corporation
(OMC)
for an adjusted standard.
The
Agency response was originally due March 16,
1994.
The Agency
requested and has been granted two previous extensions, the
second of which extended the due date until September 12,
1994.
In support of the motion, the Agency states that the parties
are discussing the possibility of the Agency becoming
a co-
petitioner.
The Agency states that the ultimate acceptance of a
co—petition hinges on the resolution of several issues the Agency
raised and which ONC was to investigate.
The Agency further
states that ONC is preparing
a proposed co-petition, but has not
yet submitted it for Agency review.
Therefore, the Agency states
that the requested extension is necessary to allow ONC to
complete the proposed co-petition, and to allow the Agency to
review it prior to making its recommendation.
We grant the Agency an extension until November 25,
1994 to
file its recommendation.
Alternatively,
if further time is
needed for development of the joint petition, to allow on-going
negotiations, or to allow the Agency to complete its review of
the proposed petition, the parties are directed to file status
reports, either jointly or independently,
by that date.
