This matter comes before the Board on a petition filed on

June 12,

1991.

On October 21,

the Board directed the

parties to file

a status report on or before December 16,

1993,

concerning

the

status

of

this

matter.

On

December

15,

1993,

Safety—Kleen filed a status report with the Board.

Safety-Kleen

stated that

the parties met

and that they

are making progress

towards

resolving

this

matter.

Safety-Kleen

stated

that

the

parties

are resolving the

matter

and that

at

this time

it

is

awaiting

final

documentation

from

the

Illinois

Environmental

Protection Agency (Agency) memorializing the settlement agreement.

Safety-Kleen further states that they and the Agency have been

able to come to agreement on four other similar

closure appeals

using

the

documentation

developed

during

these

negotiations.

Safety-Kleen

has

also notified

the

Agency

of

its

interest

in

resolving this matter expeditiously.

The parties are directed to file an updated

status report on

or before January 28,

1994.
