    v.
    )
    PCB 92—205
    (Permit Appeal)
    ILLINOIS ENVIRONMENTAL
    PROTECTION AGENCY,
    Respondent.
    ORDER OF THE BOARD
    (by R.C.
    Flemal):
    On November 24,
1993 the parties filed a joint status report
and motion to continue1 this petition for review of the Illinois
Environmental Protection Agency’s denial of an air pollution
    permit.
The parties state that on November
    4,
    1993 the Board
    granted Douglas Furniture of California,
    Inc. an adjusted
standard from the air pollution control requirement provided at
    35 Ill. Adm. Code 218.204.
Based upon the Board’s granting of
the adjusted standard in that related matter, the parties
reasonably believe that agreement will be reached through
    negotiation in this permit appeal.
    Therefore,
    the parties
request that the Board stay this matter to allow for settlement
    discussions.
The Board notes that this matter has a statutory decision
    ieadline of June 23,
    1994.
    Therefore,
    the Board declines to
grant an unlimited stay of this proceeding.
    Rather, the Board
grants the motion to stay for a limited time until February 8,
    1994.
    The Board accepts the parties’
    status report and directs
the parties to file an additional report indicating the status of
any ongoing negotiations between the petitioner and the
respondent on or before February 8,
    1994.
    If this case is not
dismissed or otherwise resolved by February 8,
    1993,
    and a
    hearing is required,
an additional waiver of the statutory
decision deadline should be filed in conjunction with the
    February status report.
The Board requires 120 days in which to
schedule hearing, give public notice, establish a briefing
schedule, receive and review the transcript and fully deliberate
    ~n the matter.
Under such time constraints, the Board will be
required to set this matter for hearing sometime in February
~iithouta waiver of the statutory deadline.
    1
The Board contrues this motion to continue to be a motion
    ~o stay the proceeding.

    2
