    ORDER OF THE BOARD

    This matter comes before the Board pursuant to the Grigoleit
    Company’s
    filing
    of
    a
    status
    report
    on November
    10,
    1993
    as
    directed by Board order of September 23,
    1993.
    The Agency filed
    its status report on November 16,
    1993 accompanied by a motion to
    file the status report instanter.
    The Board grants the motion to
    file instanter and hereby accepts Grigoleit and the Agency’s status
    reports.
    The Board directed the parties to file status reports on
    August
    5,
    1993, August 26,
    1993 and most recently, September 23,
    1993,
    based upon the Agency’s filing of
    a Petition for Leave to
    Appeal
    in the Illinois
    Supreme
    Court
    of
    a
    case related to the
    instant matter: The Grigoleit Conrnanv v. IEPA,
    (December 6, 1991),
    PCB 89-184,

    The Grigoleit Company
    indicates
    in
    its status
    report that
    several
    of the
    interested
    parties,
    including
    the
    Board,
    filed
    objections to the Petition for Leave to Appeal and on October
    6,
    1993, the Illinois Supreme Court denied the petition.
    However, on
    October
    28,
    1993,
    the Agency filed a Motion for Leave to File a
    Motion for Reconsideration to which the Grigoleit Company and this
    Board have filed objections.
    Accordingly,
    the parties
    are directed
    to
    file
    an updated
    status report on or before December 27,
    1993.
