ORDER OF THE BOARD

This matter
comes before the Board
on Berkshire Furniture
Company,
Inc. and the People of the State of Illinois’ Joint Status
Report
filed
on October
15,
1993.
The status
report was filed
pursuant to
a Board order of July
14,
1993 granting a motion to
continue hearing until October 15,
1993 and directing the parties
to file a status report on or before October 15, 1993 in the event
this case has not yet been closed.
The status report indicates that the parties have engaged in
substantial settlement discussions relating to the resolution of
the issues raised by the People’s complaint.
The report further
states
that
the
parties
have
discussed
the
latest
written
settlement proposal and they have come to an agreement with respect
to the specific language of all but one paragraph of the proposed
settlement agreement.
The status report specifically provides the following:
“4.
It is the sense of the attorneys subscribing to this
status report that
a final,
fully executed settlement
agreement will be ready to file with the Board within two
weeks from the date of entry of this status report.”
Based on this representation,
the Board will not order a further
status report in this matter.
However, the Board will, on its own
motion,
extend the continuance with regard to the hearing date for
an additional two weeks from today’s order,
or until November
4,
1993.
If the parties have not filed
a
settlement agreement by
November 2,
1993 by 4:30

35 Ill.
Adm. Code Section 101.181),
the Board will,
at
its November
4,
1993 Board Meeting,
issue an
order setting this case for hearing.
