IN THE MATTER OF:

AS 92—13
PETITION OF ALUMAX INC.
)
(Adjusted Standard)
FOR ADJUSTED STANDARD FROM
)
35
ILL. ADM. CODE PART 218
)
ORDER OF THE BOARD
(by B.
Forcade):
On October 20,
1993, Alumax filed a “Notion for Extension of
Time to File a Second Amended Petition for an Adjusted Standard”.
Alumax requests an additional extension of 30 days to file a
second amended petition.
The Board has previously extended the
time to file the amended petition until November 12,
1993.
Aluinax states that an extension is needed due to ongoing
negotiations and exchanges with the Environmental Protection
Agency (Agency).
In particular, Alumax notes that the Agency has
requested the testing of emissions.
This test have been
completed and the results received on October 12,
1993.
Aluinax
contends that an extension will prevent piecemeal amendments and
allow Aluinax to submit an amendment that reflects the
deficiencies cited by the Board and the negotiations with the
Agency.
Alumax indicates that the Agency is in support of the
motion.
The Board grants Aluinax a
30 day extension from November 12,
1993 to file a second amended petition.
The Board notes that the
second amended petition is now due on or before December 13,
1993.
IT IS SO ORDERED.
