    ORDER OF THE BOARD

    Pursuant to the Pollution Control Board’s order of March 25,
    1993, the parties filed a joint status report and request for
    stay on October
    4,
    1993.
    On February 8,
    1993, the Agency and
    Stiffel filed a joint status report in this matter.
    The joint
    status report explained that the Agency found Stiffel’s plan
    regarding compliance with the 35 Ill.
    Adm. Code Part 218, Subpart
    F regulations to be acceptable,
    and that the Agency was “in the
    process of preparing a recommendation to the Office of the
    Illinois Attorney General regarding a consent agreement that
    embodies the compliance plan.”
    The Agency reports that it is still in the process of
    preparing a recommendation to the Office of the Illinois Attorney
    General.
    It explains that the delay
    in making the recommendation
    to the Attorney General’s office is due to the additional
    technical and related considerations that have arisen.
    The
    Agency states that it has addressed these additional
    considerations,
    finds Stiffel’s compliance plan acceptable,
    and
    anticipates forwarding its recommendation to the Office of the
    Illinois Attorney General within the next forty-five
    (45)
    days.
    The Agency and Stiffel anticipate that the consent agreement
    will resolve all outstanding issues.
    Both the Agency and Stiffel
    agree,
    therefore, that no hearing should be scheduled in this
    matter at present.
    The Agency and Stiffel request,
    therefore,
    that the Board stay this matter.
    The Agency and Stiffel agree to
    provide the Board with a status report in six
    (6) months.
    The parties’ motion for stay is granted.
    An updated status
    report, and the Agency’s response to the petition, are due to be
    filed on or before March
    1,
    1994.
    The Agency
    is cautioned to
    move for any extension of time it may need to file its response
    to the petition in advance of the date on which the response is
    due.
