ORDER OF THE BOARD:
This matter comes before the Board upon a June 28,
1993
filing of an Administrative Citation pursuant to Section 31.1 of
the Illinois Environmental Protection Act
(Act)
by Sangamon
County.
A copy of that Administrative Citation
is attached
hereto, but will not be printed in the Board’s Opinion Volumes.
Service of the Administrative Citation was made upon Robert and
Rita Frohwitter on June 26,
1993.
Sangamon County alleges that
on May 27,
1993 Robert and Rita Frohwitter,
present owners and/or
operators of a facility located
in Sangamon County and commonly
known to the Agency as Gardner Township/Frohwitter, violated
Section 21(p) (1)
of the Act.
The statutory penalty established
for this violation is $500.00 pursuant to Section 42(b)(4)
of the
Act.
Robert and Rita Frohwitter have not filed
a Petition for
Review with the Clerk of the Board within 35 days of the date of
service as allowed by Section 31.1(d) (2)
of the Act.
Therefore,
pursuant to Section
31.1(d) (1),
the Board finds that Robert and
Rita Frohwitter has violated the provision alleged
in the
Administrative Citation.
Since there is one
(1) such violation,
the total penalty to be imposed is set at $500.00.

It is hereby ordered that, unless the penalty has already been
paid, within 30 days of the date of this order Robert and Rita
Frohwitter shall,
by certified check or money order payable to
the Sangamon County Public Health Department, pay a penalty
in
the amount of $500.00, which
is to be sent to:

Respondents shall include the remittance form and write the
case name and number and their social security or federal
Employer Identification Number on the certified check or money
order.
3. Penalties unpaid after the due date shall accrue interest
pursuant to Section 42(g)
of the Illinois Environmental
Protection Act.
4. Payment of this penalty does not prevent future prosecution if
the violation continues.
Section 41 of the Environmental Protection Act,
(415 ILCS 5/41
(1992)), provides for appeal of final orders of the Board within
35 days.
The Rules of the Supreme Court of Illinois establish
filing requirements.

That
the
Respondents,
Robert
Frohwitter
and
Rita
Frohwitter,
are
the
present
owners,
and
the
Respondent,
Jim
Withers,
is
the present operator,
of a facility
located
in
the
County
of
Sangamon,
State
of Illinois.
2.
That
said
facility
is an open
dump,
operating without an Illinois
Environmental
Protection
Agency
Operating
Permit,
and
designated
with
Site
Code
No.
1678110009.
Said
facility
is
commonly
known
to
the Agency
as
Gardner
Twp. /Frohwitter.
3.
That
the
Respondents,
Robert
Frohwitter
and
Rita
Frohwitter,
have
owned
said
facility,
and
the
Respondent,
Jim
Withers,
has
operated
said
facility, at all times pertinent
hereto.
4.
That on

27,
1993,
Jerry Ferguson,
Waste Management
Specialist
with
the
Sangamon
County
Department
of
Public
Health,
inspected
the
above-described
facility.
A
copy
of
the
inspection
report
setting
forth
the
results
of
such
inspection
is
attached
hereto
and
made a
part
hereof.

the
basis
of
the
direct
observations
of
Jerry
Ferguson,
Sangamon
County
has
determined
that
Respondents
have
caused
or
allowed
open
dumping
at
the
above-described
facility
in
a
manner
which
resulted
in
the
following
occurrences:

an

Pursuant

subject

a
civil
penalty
of
Five
Hundred
Dollars

thereunder,

Respondents

to

the
Illinois
Pollution
Control
Board
under
the

reason of
acknowledgement,
default or finding after adjudicatory hearing is not paid when due, the Office

requested
to initiate proceedings
in Circuit
Court
to
collect
said
civil
penalty.

addition
to
the
previously
assessed
civil
penalty,
interest,
and
hearing
costs
of
Sangamon
County
Agency
and
the
Illinois
Pollution
Control
Board,
if
any,
the
Attorney
General’s
Office
or
the
Sangamon
County
State’s
Attorney
will
seek
to
recover
their
costs
of
litigation.
