1.
That Charles
L. Parker (“Respondent”) is the present ownerof a property located in
Logan County,
Illinois, and described as follows:
All that part of the North Half of the Southwest Quarter of Section 32, Township 20
North, Range2Westofthe3~dP.M.,
Logan County, Illinois, Iyingsouthofthesouth
line of the
right
of
way of the
Champaign-Havana
Branch
of
the
Illinois
Central
Railroad Company
and
east of
the southeasterly line of the right
of
way
of the
Peoria-Evansville Branch of the said railroad companyand westof the northwesterly
line of the right of way of the wye
track connecting
the said
champaign-Havana
Branch (Havana District) and the Peoria-Evansville Branch
(Peoria District) of said
railroad company.
The property is commonly known to the Illinois EnvironmentalProtection Agency as Lincoln/Parker.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and is designated with
Site Code
No.
1078055001.
3.
That Respondent has
owned said facility at all times pertinent hereto.
4.
That on
March
25, 2004,
William Zierath
of
the Illinois
Environmental
Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-described
facility.
A
copy
of
his
inspection
report setting
forth the
results of said
inspection
is attached
hereto and
made
a part
hereof.
VIOLATIONS
Based upon direct observations made byWilliam Zierath during the course of his March 25,
2004 inspection
of the above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of Section 21(p)(l) of the
Act, 415
ILCS 5/21(p)(1)
(2002).
(2)
That
Respondent caused
or allowed
the open
dumping
of
waste
in
a
manner
resulting
in
open
burning,
a
violation
of
Section
21(p)(3)
of
the
Act, 415
ILCS
5/21 (p)(3) (2002).
(3)
That
Respondent
caused or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
constructionor demolition debris, a violation of Section 21(p)(7) of theAct, 415 ILCS
5/21 (p)(7) (2002).
CIVIL
PENALTY
Pursuant
to
Section
42(b)(4-5) of the Act,
415
ILCS
5/42(b)(4-5) (2002),
Respondent
is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for each
of the
violations
identified
above,
for
a
total of
Four Thousand
five
Hundred
Dollars
($4,500.00).
If
Respondent elects
not
to
petition
the
Illinois
Pollution
Control
Board,
the statutory
civil penalty
specified above shall be due and payable no later than June 15,2004, unless otherwise provided by

order of the Illinois Pollution
Control Board.
If Respondentelects to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1 of theAct, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing
costs incurred by the Illinois
Environmental
Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in
addition
to the One Thousand Five
Hundred
Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuantto Section 31.1(d)(1) of theAct, 415 ILCS 5/31.1(d)(1) (2002), if Respondentfails
to petition orelects not to petition the Illinois Pollution Control Board for reviewof this Administrative
Citation within thirty-five (35) days of the date
of service, the Illinois Pollution
Control
Board shall
adopt a
final
order,
which
shall include
this Administrative Citation
and
findings
of violation
as
alleged herein, and shall impose the statutory civil penalty specified- above.
When
payment

made,
Respondent’s

shall

A complaint
follow-up investigation was conducted at this site on March
25,
2004. No
one else was at the site during this investigation. The weatherwas cloudy, raining and
60°F.
An inspection was conducted at this site
on November
10, 2003. An Administrative
Citation Warning Notice was sent to
Charles Parker, the owner of this property,
in
January 2004. The ACWN specified that wastes must be removed from the site by March
15,
2004.
The AC1vVN specified that a written response specifying proposed corrective
actions was to
have been submitted within
15
days ofreceipt of the ACWN. To date the
Agency has not received a response from Mr. Parker.
The purpose of this inspection was
to determine if the wastes previously observed at this site had been removed.
During the November
10, 2003 inspection it was observed that there were several large
piles oflandscape waste at the site. The landscape waste observed in November had been
burned prior to this inspection.
Some ofthe wood was still burning at the time ofthe
inspection. There was a small
endloader/backhoe located near the burn area. There were
tire tracks and scrape marks near the burn area that indicated the endloader had been used
to move some ofthe landscape waste to the burn location. The burn pile is shown in

I looked on-site forthe stumpsfrom trees that might
indicate that the landscape
waste being burned had been generated on this property. I
could not findany such stumps or any areas where the soil hadbeen disturbed as though
stumpshad been
removed.

There were a sofa, a chair and some old
carpeting that had been dumped south ofthe burn
pile. These waste

There were 16 used tires stacked near a storage building. At least two of the tires were
still on rims.
Several other tires were observed to be offrims.
There was water
