On August 13,
1992,
the Board ordered the parties to file
status report on or before November 15,
1992’.
The petitioner
filed its status report on November 16,
1992.
No status report
was received from the respondent.
The petitioner states that the petitioner’s and the
respondent’s representatives have met to discuss the work plan
for the column leaching test.
The petitioner reports that the
respondent
is currently reviewing the work plan in
light of
issues discussed at the meeting.
The petitioner has granted an
additional 60-day waiver of the decision to accomodate the
respondent’s review.
The Board is disturbed by the respondent’s failure to
respond to the Board’s order for a status report.
As a result,
the record contains no information on the cause of the
respondent’s delay
in reviewing the work plan.
The parties
previously reported that the respondent’s decision on the work
plan was expected
by September 15,
1992.
The parties are ordered
to provide status reports to be received by the Board
no later
than February
1,
1993.
The status reports shall include the
expected date of resolution of this matter.
IT IS SO ORDERED.
The Board notes that this date
fell on a Sunday,
therefore
the reports were due
or! November 16,
1992.
