ORDER OF THE BOARD

C. Marlin):
This matter comes before the Board on a motion filed
November 19,
1992,
by the complainant, the Illinois Environmental
Protection Agency (Agency).
The Agency’s motion requests that
the Board grant the Agency either an extension of time,
or leave
to file instanter the proposal and stipulation and the motion to
dismiss Herman
L. Loeb.
The Agency cites last minute approval
delays as cause for the delay in filing.
In its motion the Agency states that the attorney for
respondent Johnson has no objection to this motion.
In addition,
the Agency states that the proposal and stipulation and motion to
dismiss are now complete and are on their way to the Board.
However,
as of today, the documents have not yet been received by
the Board.
The Board denies the Agency’s motion to file instanter but
grants the Agency’s motion for an extension of time.
The
documents must be received by the Board no later than 4:30 p.m.
