ORDER OF THE BOARD

On September 8,
1992,
the Board received a letter from Tim
and Charity Heiden.
The letter was not specifically addressed to
the Board.
A slip of paper was stapled to the original which
reads:
We have sent this letter to anyone we feel
may address this issue in such a way that may
help small businesses today and in the
future.... and maybe someday our problem will
be resolved.
The letter details the underground storage tank replacement
incident which gave rise to this appeal.
Among other things, the
letter states that an appeal was filed, but that
‘(in
a
telephone conversation with the IEPA it was agreed that we would
try to resolve the case before going before the Board”.
The
letter expresses frustration about the fact that the case has not
been resolved.
There is no indication that counsel for the parties have
received this letter.
The Board directs its Clerk to serve them
a copy of the Heiden’s letter along with this order,
and to serve
the Heidens a copy of this order via first class mail.
The Board notes that, by order of September 8,
1992, the
hearing officer set this matter for hearing on October 13,
1992.
The parties are directed to conclude this matter expeditiously.
