OF THE BOARD

On September 15,
1992, R. Lavin
& Sons, Inc.,
(Lavin)
filed
a waiver of decision date in this proceeding.
In its waiver,
Lavin states that it is continuing discussions with the
ilinois
Environmental Protection Agency
(Agency) concerning the related
permit appeal, PCB 91-139, and that it is also negotiating with
the North Shore Sanitary District and the
City
of North Chicago
to reroute some of Lavin’s stormwater discharges.
Lavin believes
that resources of the Agency, Lavin, and the Board will be
preserved if the parties await the outcome of these discussions.
Lavin has supplied the Board with a waiver of the final decision
deadline in this matter until June 30,
1993.
The Board hereby orders that the parties submit status
reports to be received by the Board on or before February
1,
1993.
