PETITION OF THE CITY OF

PERU FOR EXCEPTION TO THE

 PCB 86-1
COMBINED SEWER OVERFLOW
 )
 (CSO Exception)
REGULATIONS
 )
ORDER OF THE BOARD
 (by J. Theodore Meyer):
This matter is before the Board on the City of Peru’s petition
for exception
 to the combined sewer
 overflow
 (CSO)
 regulations
found at 35 Ill.Adm.Code 306.305(a) and
 (b).
 On April
 1,
 1987, the
Board granted Peru a temporary exception from the CSO rules, with
the requirement that Peru file an amended petition for permanent
exception.
The instant petition for exception is filed in response
to that requirement.
 The petition
 is
 accepted,
 and this matter
will
 continue
 pursuant
 to
 the
 procedures
 of
 35
 Ill.Adm.Code
306.Subpart
 D.
 While
 those
 procedures
 expired
 in
 1986.,
 in a
handful of cases, such as this, the Board retained jurisdiction of
the
 matter
 so
 that
 it
 could
 consider
 the permanent
 exception
 pursuant to those rules.
IT IS SO ORDERED.
I,
 Dorothy N.
 Gunn,
Clerk of the Illinois Pollution Control
Board,
 hereby certi~y that the
 above
 Order was
