ORDER OF THE BOARD BY

This matter comes before the Board on a April
2,
1991 filing
by the
respondent,
John
A.
Gordon.
The filing consisted of
a
letter which states,
in full:
“Because of financial hardship,
I had requested that the
hearing
costs
in the
above
case be
waived.
I
would
respectfully request that those costs be reconsidered.
Also,
I would request that the assessed penalty be paid
in five equal monthly payments.”
The letter did not indicate whether or not it had been served on
the Agency.
The
final
decision of the Board
against the respondent on
March 14, 1991 assessed a statutory penalty and hearing costs.
The
Board is construing the April 2nd letter as a timely filed motion
for reconsideration of that
final Opinion and Order.
An Agency
response to Mr. Gordon’s letter would be appreciated and should be
filed in the Board’s office no later than April 25,
1991.
