ORDER OF THE BOARD
(by N.
Nardulli):
This matter comes before
the
Board
on the January
4,
1991
filing of Allied-Signal’s
amended claim
for confidentiality
and
statement of justification.
Allied claims confidentiality in pages
17,
18, 46, 47, 47a, 47b, 47c and 47d of its Engineering Evaluation
Report
which
it was
required to
file pursuant
to the variance
granted on November
2,
1989.
On November 28,
1990,
Allied filed
nine copies of its report but claimed the report as a trade secret
pursuant to 35 Iii. Adm. Code 120.201(a).
In its
amended claim of
confidentiality and statement of justification, Allied states that
only certain pages of the report should be treated as confidential.
The Board accepts Allied’s statement of justification.
However,
since Allied is only claiming confidentiality as to certain pages
in the report, Allied is directed to file with the Board no later
than January 22,
1991 one copy of the report with the confidential
information expunged
so that
the
Board may properly
place
the
report with the expunged information in its public file.
IT IS SO ORDERED.
I,
