On November 1,
1990 Respondent filed a Report of Abatement
Procedures with the Board.
Though the report indicates further
abatement devices have been installed, the report shows continued
exceedances of the Board’s nighttime noise regulations.
Respondent offered explanations of some higher ambient noise
readings,
attributing these to crickets and automobile traffic.
However, the rooftop fans and furnaces continue to register
exceedances.
Also,
as Complainant points out in its November 28,
1990 reply,
the report does not indicate whether all rooftop
equipment was activated during the testing.
Unless compliance is demonstrated by January 30,
1991, the
Board may impose penalties as indicated in the Act.
