    On November
    13,
    1990 Gallagher Asphalt
    (“Gallaghert’)
    filed
    its Report Regarding Implementation of Remedial Action, which was
    required to be filed pursuant
    to the Board’s Opinion
    ar~.d Order
    of
    July 19,
    1990.
    In its Interim Opinion and Order
    of January 11,
    1990,
    the Board had found that Gallagher violated Section
    24
    of
    the Illinois Environmental Protection Act and the Board’s
    noise
    regulations found at
    35
    Ill. Adm. Code 900.102.
    Gallagher asserted that
    it has implemented all of
    the
    measures required by the Board and submitted the affidavit of
    Donald Gallagher
    in support thereof.
    Gallagher requests that the
    Board dismiss the matter
    with
    prejudice.
    This matter
    has already
    been adjudicated by the Board.
    Gallagher’s motion to dismiss
    is
    denied.
    Unless
    the Board receives
    a response from the Complainant
    by December
    14,
    1990,
    indicating
    that Gallagher has not complied
    with the Board’s order,
    this docket will be closed on January 10,
    1991.
