    AND
    ORDER OF THE BOARD BY

    On February
    8,
    1990, the Board entered an Interim Opinion
    and Order in this matter. which found by a 4-3 vote that Koppers
    Company,
    Inc.
    (Koppers) had violated Section 9 of the
    Environmental Protection Act.
    That Interim Opinion and Order
    found that emissions of naphthalene and creosote odors from the
    Koppers’ facility were unreasonable and constituted
    a substantial
    interference with the enjoyment of life and property of the
    complainants.
    After making that finding, the Board retained
    jurisdiction and ordered Koppers to prepare and submit a report
    on the methods,
    costs,
    and timing of pollution control strategies
    taken by Koppers and planned for the future.
    Koppers filed its
    report, compiled by Mittlehauser Corporation,
    a chemical
    engineering company, on April
    25,
    1990.
    Petitioner, Peter
    Arendovich,
    filed comments on May 24,
    1990.
    The report filed by Koppers corrects a deficiency
    in the
    record of this matter.
    The report details Koppers efforts to
    control the air emissions from various equipment and operations.
    Repairs and modifications that have been completed include the
    repair or replacement of hatches and vents on a number of
    systems,
    the renovation of the distillation vacuum system,
    and
    the installation of inert gas purge systems to reduce vapor
    emissions during the cleaning of transmission lines.
    Other
    control strategies in the process of being completed include the
    modification and upgrading of the “F-2” topped tar fume recovery
    system.
    The report also specifies three emission sources where
    future improvements are being investigated.
    Koppers
    is
    conducting an evaluation of the available odor abatement

    technologies for the creosote blending and loading storage tanks.
    A similar study
    is being conducted for the naphthalene unloading
    process.
    An evaluation has already been completed on the options
    for connecting the coal tar feed tanks to the fume system,
    F—2,
    or the addition of a new fume system.
    The report states that
    that study led Koppers to a determination that both options would
    not be cost effective.
    Mr. Arendovich, one of the petitioners, criticized the
    report and the improvements made at the Koppers’ plant.
    He
    stated that the creosote odors still occur and interfere with his
    enjoyment of life and property.
    Mr. Arendovich would like to see
    a monitoring system installed at the Koppers Plant.
    The Board will accept Koppers’ report and commitment to
    improve
    its operations.
    Koppers
    is hereby ordered to continue
    efforts to minimize odor emissions and finish the projects listed
    in the report submitted to the Board on April
    25.
    This Final
    Order does not preclude other enforcement actions being brought
    against Koppers if the violations continue.
    The foregoing discussions, together with those included in
    the February 8,
    1990 Interim Order, constitute the Board’s
    findings of facts and conclusions of law in this matter.
    ORDER
    For the foregoing reasons, the Board hereby Orders Koppers
    Company, Inc.,
    respondent, to undertake and perform Item Numbers
    I through XII of Table 4-1 from the “Illinois Pollution Control
    Board Report submitted to the Board on April 25,
    1990.
    A copy
    Of
    Table 4-1 is appended to the Order.
    In addition, Koppers
    is to
    add a yearly inspection of all hatches and vents within the vent
    maintenance program.
    Koppers shall cease and desist from all
    violations of the Act and Board regulations.
    Section 41 of the Environmental Protection Act,
    I11.Rev.Stat.1989,
    ch.
    111
    1/2, par.
    1041, provides for appeal of
    final Orders of the Board within 35 days.
    The Rules of the
    Supreme Court of Illinois establish filing requirements.
