ORDER OF THE BOARD
(by J. Anderson):
On July
3,
1990,
the Board issued an Order directing Modine
Manufacturing Company,
Inc.
(“Modine”)
to inform the Board of the
effect of its determination in R87—36 on the scope of relief
requested
in this proceeding.
Such information was
to be filed
with the Board on or before July 27,
1990.
On July
27, 1990,
Modine filed a Motion for Additional Time,
requesting a two week
extension of time to respond to the Board’s July
3,
1990 Order.
In support of
its motion, Modine states that,
in an attempt
to
prepare
a response,
it has consulted with the Illinois
Environmental Protection Agency (“Agency”) and that discussions
are ongoing.
Modine also states that the Agency permit engineer
who is drafting
a revised NPDES permit
in response
to the grant
of
site—specific relief
in R87—36
is on vacation,
and that the
Agency has no objection
to Modine’s request
for additional
time.
Based on
the foregoing,
the Board grants Modine’s Motion
for Additional Time,
and directs Modine
to file its response to
the Board’s July
3,
1990 Order on or before August
13, 1990.
