    ORDER OF THE BOARD

    This matter
    is
    before the Board
    on petitioner the
    City
    of
    Batavia’s
    (Batavia)
    motion
    for
    extension
    of
    time
    to
    file
    a
    supplemental
    exhibit,
    filed July
    9,
    1990.
    On June
    7,
    the Board
    ordered that Batavia submit a copy of an executed contract for the
    purchase of the “Harris
    Bank” property by July
    9,
    1990.
    In the
    instant motion,
    Batavia maintains
    that
    the negotiations for the
    purchase
    of
    the
    property
    took
    longer
    than
    expected,
    that
    negotiations are now complete,
    and that
    it
    anticipates that the
    contract for purchase will be executed
    and approved by the city
    council by July 16,
    1990.
    Therefore, Batavia asks that the Board
    allow
    it
    until
    July
    19,
    1990
    to
    file
    a copy
    of
    the
    executed
    contract for the land purchase.
    Batavia states that the motion is
    not made for purposes of delay or harassment, and that the Illinois
    Environmental Protection Agency
    (Agency) has no objection
    to the
    motion.
    Although the motion
    is not accompanied by an affidavit
    (see
    35 Ill. Adm.
    Code 101.242), the Board will grant the motion in the
    interests
    of developing a complete record.
    The Board notes that
    Batavia filed a copy of the agreement on July 17,
    1990.
