On July 10,
1990,
the City moved
for a two year extension of
the variance granted by the Board on January
8,
1987.
A three
year variance was granted from 35
Ill. Adm. Code 602.105(a)
Standards of Issuance and 602.106(b) Restricted Status as these
rules relate
to exceedances from the combined radium limitation
of 604.301(a) and the gross alpha particle activity limitation
of
604.301(b).
This variance expired by its terms on January
8,
1990.
The motion for extension is denied on procedural grounds.
Given the fact that
this variance has expired, and further
that
citizens had filed written objections to the original petition,
the merits of the City’s
request would be best considered by the
Board
in the context of a new petition for variance.
The Board
declines
to reopen this case.
