ORDER OF THE BOARD
(by J. Anderson):
On May 24,
1990, the Board issued a final order
in P87—36,
granting site-specific relief to Modine Manufacturing Company,
Inc.
(“Nodine”).
In the order,
the Board adopted site-specific
effluent standards for two parameters,
five—day biochemical
oxygen demand and total suspended solids,
as well as a site—
specific water quality standard for fluoride.
On June
7,
1990, the Board issued an order in PCB 86-124
(permit appeal),
directing Modine to file a response regarding
whether the issues
in the permit proceeding were moot as a result
of the Board’s determination in P87-36.
On June
29,
1990, Modine
filed its response to the Board order and a Motion for Remand.
Although both filings stated that the Agency was reconsidering
the permit in light of the grant of site—specific relief, there
was only
a brief mention of the fact that this variance case was
pending before the Board.
The Board notes, however, that the
limits proposed in the instant case are,
in large part, the
limits sought in the site-specific proceeding.
As a result,
Modine may have to redefine the scope of the requested relief in
this case in light of the Board’s opinion and order in P87-36.
Thus, the Board hereby directs Modine to inform us of what
effect,
if any,
our determination in P87-36 has on the scope of
the relief requested
in this proceeding.
Nodine’s response
should be filed on or before July 27,
1990.
