1990 the Illinois Pollution Control Board
(“Board”)
adopted Modine Manufacturing Company’s
(“Modine”)
petition for a site-specific rule change,
R87—36.
Since Modine
was granted site—specific relief the issues
in the permit
proceeding apparently are moot.
The Board requests that the petitioner, no later
than June
28, 1990, file a motion to dismiss
or
other appropriate pleading
addressing this mootness issue.
Otherwise,
this case will
be
subject
to dismissal at
the Board meeting, scheduled for July
3,
1990.
