ORDER OF THE BOARD
(by J. Anderson):
This matter is before the Board on the May 21,
1990 filing
of a Petition to Modify Opinion and Order of Board from the
Village of Mundelein
(flMundeleinu).
Mundelein seeks
a
modification of the Board’s Order of April 26,
1990,
granting
Mundej.ein a variance from 35
Iii.
Adm.
Code 602.105(a)
and
602.106(b)
subject to certain conditions.
Mundelein asserts that
the Illinois Environmental Protection Agency has no objection to
the petition.
Mundelein requests the Board to modify this condition
5 of
its order by changing the date by which
it must advertise for
bids from August
1,
1990,
to November
1,
1990.
In support of its
request, Mundelein points to condition
4 of the Board’s order
which states that Mundelein is to apply for the construction
permit that is needed to achieve compliance by August
1,
1990.
Nundelein correctly notes that the Agency has
90 days to review
the permit application and that it cannot advertise for bids
until
it has received a construction permit from the Agency.
The
Board will therefore modify condition
5 to read as follows:
By November
1,
1990, Mundelein shall advertise for bids
to be submitted within 60 days,
from contractors to do
the necessary work described
in the construction
permit.
Mundelein shall accept appropriate bids within
a reasonable
time.
Petitioner
shall notify the Agency
at the address
in condition
(4)
of each of the
following actions:
1)
advertisement for bids,
2)
names
of successful bidders, and
3)
whether Mundelein
accepted other bids.
