Paragraph

5 of the Board’s Order dated October

19, 1978

is hereby amended to read as follows:

“5.

The variance from Rule 404(f)

granted in

Paragraph 2 of this Order does not apply to any

discharger who,

by virtue

of a prior variance or

NPDES permit

is presently allowed to discharge

at a level in excess of 10 mg/i BOD and

12 mg/l

suspended solids except that during the effective

period of this variance, any renewed NPDES permits

and/or variances granted to

such dischargers shall

contain BOD and suspended solids effluent limita-

tions no more stringent than 10 mg/i BOD and 12

mg/i suspended

solids.’t
