It
is
the Order of the Pollution Control Board that:
1)
Petitioner be granted a variance from Rules
605 of Chapter
4:
Mine Related Pollution and 203(f)
of Chapter
3: Water Pollution
as
they pertain to sulfate and total dissolved solids for three years
from the date
of this Order or until the Board reaches final deci-~-
sions
in R76-7 and R77-l0, whichever occurs first,
subject to the
following conditions:
A)
During the term of this variance Petitioner shall comply
with the management requirements in its NPDES Permits.
B) Within
60 days after publication of the Codes of Good
Mining Practices by the Mine Related Pollution Task Force,
Petitioner shall submit a report to the Agency outlining
specific steps
it intends
to take at the Streamline Mine
to comply with the Codes of Good Mining Practices and to re-
duce the levels of sulfate and total dissolved solids in its effluent,

During the term of this variance Petitioner shall comply
with the following effluent limitations for the discharges
from the Streamline Mine:

days
of
the
date
of
this
Order,
petitioner
shall
execute
a
Certification
of
Acceptance
and
agreement
to
be
bound

all
the
terms

conditions
of
this
variance.
The

day
period
shall
be
held
in
abeyance
while
this
matter
is
appealed.
The
Certification
shall be forwarded to Illinois
Environmental
Protection
Agency,
Mine
Pollution
Control
Program,

Churchill
Road,
Springfield,
Illinois
62706
and
shall
read
as
follows:

understanding
the
Order
in
PCB
79-12,
hereby
accept
that
Order
and
agree
to
be
bound
by
all
of
its
terms
and
conditions.

2)
Petitioner shall request modification of its NPDES Permits
to reflect the appropriate numbers and locations of its
discharges.
3)
The Agency shall modify Petitioner’s NPDES Permits in a
manner consistent with the terms of this Order.
