This matter
comes before the Board
on

motion
to
dismiss
a
party
respondent
filed
by
the
Illinois
Environmental Protection Agency (Agency).
In support of its motion
the Agency states that the respondent Farmers
& Merchant State Bank
is “merely
a trustee with no culpability,” and that the Default
Order against the respondent State Bank has already been vacated
by Board order of December
6,
1989.
This motion is granted and the complaint shall be amended to
have only Wayne D. Nolen as respondent.
The respondent Wayne Molen
is granted 35 days from the date of this Order to file a Petition
for Review of this Administrative Citation.
